Terms of Service

1. What this covers

These terms cover use of this website: reading its pages, submitting the contact form, and following links off it. They are not the terms of a consulting engagement. Those are agreed separately, in writing, before any paid work starts, and the general shape of them — pricing, invoicing, notice periods, confidentiality — is published on theservices page rather than repeated here.

2. Content and intellectual property

The text, writing and design on this site are mine, except where a case study describes work delivered for a client, in which case the underlying software and data remain that client's property and are described here only with their approval. You may read and link to this site freely; reproducing substantial parts of it elsewhere needs my permission first.

3. Accuracy

I keep this site reasonably up to date, but published figures — prices, timelines, capacity — are starting points rather than live quotes. The number that governs a particular piece of work is the one in the signed proposal for that engagement, not the one on this page at the time you read it.

4. The contact form

Submitting the form is not itself an offer or acceptance of any engagement. It starts a conversation. No obligation exists on either side until a scope and price are agreed in writing.

5. Liability

This site is provided as is, without warranty that it will be uninterrupted or error free. I am not liable for losses arising from your use of the information on it beyond what the law requires; nothing here limits liability that cannot lawfully be limited.

6. Governing law

These terms, and any engagement contract with me, are governed by the laws of Cambodia, without regard to conflict of law principles, and any dispute arising from either is subject to the jurisdiction of the courts of Cambodia. A signed engagement contract's own governing-law clause, if it specifies a different jurisdiction, takes precedence for that engagement.

7. Payment terms

Where a contact-form enquiry becomes a paid engagement, invoices are payable within 14 days of the invoice date unless the signed contract for that engagement states otherwise. Full invoicing terms — deposit and milestone structure, retainer billing — are published on the services page.

8. Changes to these terms

If these terms change, I will update this page and the date at the top. Terms already agreed in a signed engagement contract are not affected by a later change here.
